In the US last month, a judge ruled that Jury Nullification, a jurys ability to over-rule the law, was still lawful and very much in effect.

This follows a case in which 80 year old Julian Heicklin, was arrested by FBI agents for passing out pamphlets which informed jurors of their right to nullify a case if they thought the law being applied was unfit or unjust.

The prosecution had accused Mr Heicklyn, who was handing out the pamphlets for an organisation known as the 'Fully Informed Jury Association', of trying to influence jurors through written communication.

In 1748, French political thinker, Montesquieu, identified in De l’esprit des lois the three branches of government between which power should be allocated and separated: the executive which takes action to implement the law, defend the nation, conduct foreign affairs and administer internal policies; the legislative which makes law, and the judiciary which applies the law to determine disputes and punish criminals. According to the doctrine the executive cannot make law. Neither can the legislative determine disputes or any of the branches exercise the power of the other.

Judge Andrew Vickers has imposed a secret court and issued a ‘Gagging Order” against the Oxford Mail and Oxford Times.

A concerned Oxford resident has made the UK Column aware that Operation Bullfinch, the police investigation into the Oxford paedophile ring, successfully called for District Judge Andrew Vickers to gag the two local newspapers.

The Oxford Mail had been reporting the court case of a man who appeared in a separate court at the same time as the court appearance of six men accused of being part of the main child prostitution ring.

In addition to the gagging order, the Mail reporter was required to leave the court hearing itself.

In a landmark ruling in Hania, Crete, a Greek judge has wiped out the debt owed to banks by a full time employed civil servant.

According to Greece's Kathimerini newspaper, the judge at the Justice of the Peace court based his decision on a 2010 law that permits protection for people struggling to meet their financial commitments. To date, this law has only been used to provide relief to the unemployed.

The lady concerned is a full time civil servant with three children to support. She and her family have moved back with her parents. The court decided that she needs €350 per month to live on and that the remainder of her salary should be distributed between the four banks she owes money to.

The news today that Martin Smith has hanged himself in his prison cell has both shocked and saddened us. In a way, we should not be shocked. Martin had made it clear that he would kill himself if he got the chance, and it saddens us that we could not do more to help him.

The stories in today’s media were disgraceful. Full of vitriol; painting Martin as a heinous, perverted paedophile, they destroy his memory while at the same time heaping praise on the disgusting system which permitted the miscarriage of justice that branded Martin with those labels.

The agony of the family separating was indescribable torture. The children were given contact with us twice a week at our family home for 1.5 hours. We were always under visual supervision, with other “specialists” there observing us and our interaction with the children.

Constantly writing down what they wanted to see as if we were rats in an experimental cage. I was condemned for playing with the children, cuddling the children, lovingly caressing their heads in encouragement, indeed, every loving supportive action now done by a loving father was now taken as “grooming” ready for my sexual conquest of them. 

All physical contact with the children was banned, apart from a greeting hug and a hug goodbye. I may have well parted them by shaking their hand.

By now videos of the events in Birkenhead County Court on 7th March 2011 will have been seen around the world. If one looks closely, they were in the good old British tradition of protest. The people there had gone beyond the "muttering amongst themselves in pubs and at bus stops" stage of discontent with the Establishment, through "someone ought to do something about it" to "I will do something".

I strongly suspect that for each person present on the day, there were tens of thousands who agreed wholeheartedly with them "and felt themselves accursed they were not there" (to quote Shakespeare) and now are looking forward to the next opportunity to publicly express their discontent. And the Establishment knows this too.

Did Judge Irwin's apparent attempt to conceal evidence that Martin Smith's accuser had previously made demands for money and a car to be given to her by Lianne Smith constitute misconduct?

Lianne gave evidence from a Spanish prison over a poor quality video connection and frequently interrupted by Spanish officials who apparently did not seem to grasp the seriousness of the occasion.

You can imagine the scene: The Chief Executive of the council is advised by his legal team that their court case against the council tax rebel (me) is unwinnable lawfully because I have exposed the fact that the council have been breaking the law by issuing their own summonses... the summons is the foundation of their case and fraudulent evidence is inadmissible in a court of law, so the case must be thrown out.

The trial of Martin Smith took place in Manchester Crown Court and lasted 8 days. Mr Justice Irwin presided and the Jury found Smith guilty on 11 counts of rape, attempted rape, indecency with a child and indecent assault. Sentence is still to be passed, but in the British media, and for millions of people in UK and worldwide, Martin is already a criminal and convicted paedophile.

Few of us would disagree that the world would be a better place if we all lived by the rule-of-law – but can the same be said about living by the rule of statute? The writer thinks not.

In making the case that ‘the law’ benefits our society as a whole but ‘statutes’ benefit special interest groups and have become a negative factor in our lives let me first put forward my views as to what the differences between laws and statutes are. Here follows a summary of my interpretation of the differences (not necessarily in order of importance, sometimes repeated and definitely not exhaustive) – please feel free to challenge me if you disagree.
